Disability Insurance in Germany: Who Needs It
When occupational disability insurance (Berufsunfähigkeitsversicherung) makes sense in Germany, what the state pays and what to check in the terms.


You need disability insurance in Germany if your household lives on your earnings and you have no savings or assets that could carry you through years without them. A Berufsunfähigkeitsversicherung, the German occupational disability insurance, pays an agreed monthly amount if illness or injury means you are expected to be permanently unable to do your job. The state steps in only under narrow conditions.
There is an extra catch for newcomers: state cover depends on years of insurance in Germany, and many people who arrived as adults do not have them yet.
Who needs it most
Make a rough estimate of what you will earn between now and retirement. For most people that is more than their flat or investment account is worth. Your rent or mortgage, your children's everyday lives, your retirement savings and often the support you send to family back home all depend on it. What this insurance covers is your ability to earn a living.
The law names illness, injury and a decline in strength beyond what is normal for your age as causes, so this is not only about accidents. A back condition or a mental health condition can also end a career.
The need is clearest if one of these applies to you:
- Your household relies mainly on one income, for example because your partner is at home with the children.
- You are self-employed. Many self-employed people do not pay into the statutory pension scheme and would then have no claim to the state disability pension.
- You have only been working in Germany for a few years.
- You have long-running fixed payments, such as a mortgage.
What the state pays: the Erwerbsminderungsrente
A statutory pension for occupational disability now exists only for people born before 2 January 1961 (§ 240 SGB VI). Anyone born later can only receive the Erwerbsminderungsrente, the reduced earning capacity pension. The pension insurance does not ask whether you can still do your own job, but whether you can do any work at all on the general labour market. If you can work less than three hours a day there, your earning capacity counts as fully reduced; if you can manage at least three but less than six hours, as partly reduced.
You must also have been insured with the statutory pension scheme for at least five years before your earning capacity was reduced, and have paid compulsory contributions for at least three of the last five years (Deutsche Rentenversicherung (opens in a new tab)). Exceptions apply, for example after an accident at work or with an occupational illness, and in some cases periods of insurance in other countries count.
The pension is usually paid for a limited period and then reviewed (§ 102 SGB VI). Its amount depends on what you have paid in so far. Once you receive your annual pension statement (Renteninformation), it shows what a full reduced earning capacity pension would be if you claimed it today.

The contract terms in plain words
What a contract pays when you need it is set out in its terms. You cannot read it from the premium.
What counts as occupational disability
The law refers to the job you last did, "as it was organised before your health was impaired" (§ 172 VVG (opens in a new tab)). The contract adds from what degree of disability, and after how long, it pays.
Abstrakte Verweisung (abstract referral)
The law allows a clause under which the insurer may refer you to another job that matches your training, skills and previous standard of living. "Abstract" means it is enough that you could do that job in theory, even without having such a position. Many contracts waive this right. A concrete referral is different: it concerns a job you have actually taken up.
Guaranteed increase option and term
A Nachversicherungsgarantie lets you raise the insured amount on certain occasions, such as marriage or the birth of a child, without new health questions. If the term ends well before you retire, your last working years have no cover, even though health problems become more likely then.
How you describe your job
Describe your work as it really is day to day: how much time at a desk, how much on the move, whether you manage staff. Your classification depends on this, and if you ever claim, this is the picture the insurer checks.
Health questions: honesty protects you
Before the contract starts, the insurer asks written questions about your health. You must disclose everything you know that the questions ask about (the pre-contractual duty of disclosure, vorvertragliche Anzeigepflicht, § 19 VVG). If something material is missing, the insurer may, depending on the case, withdraw from the contract, terminate it or change its terms after the fact. This usually comes to light only when you claim, which is exactly when you need the cover.
What helps when you fill in the form:
- Do not answer from memory. Ask your doctors for records and ask your health insurer what data it holds about you; you have a right to that information.
- Unless a question is explicitly limited to Germany, treatment in your home country counts too.
- With a pre-existing condition, an anonymous risk enquiry (anonyme Risikovoranfrage) lets the insurer assess your details without your name first, so you learn whether a contract is possible and on what terms.

Common questions
Do I need disability insurance in Germany?
If your household depends on your earnings, it is one of the first policies to look at. You need it less if assets would cover your living costs for good.
What does the state pay if I cannot work?
People born from 2 January 1961 onwards can only receive the Erwerbsminderungsrente. It is measured against any job on the general labour market, requires a minimum insurance record and is usually granted for a limited period.
At what age should I take out disability insurance?
There is no fixed age. Acceptance and premium depend on your health and your job when you apply, so younger, healthy people usually find it easier to get cover. If you wait until you have a diagnosis, you may only be offered a contract with exclusions.
What I look at in a first conversation
Before we talk about any contract, I want to understand your situation: which fixed costs would continue if your income stopped, who depends on it, and what cover you already have through your pension statement, existing contracts or your employer. We also go through your work as it really looks and the records you will need for the health questions.
Then we weigh the monthly amount against a premium you can sustain, the length of the term and whether a guaranteed increase option makes sense. A contract you keep for decades protects you more than one you cancel after a few years.
